FINRA recently announced that Harold Sheldon Minsky, a financial advisor with J.H. Darbie & Co., Inc., has been fined $10,000 and suspended from association with any FINRA member in any capacity for 30 days (the suspension was effective from April 19, 2010 through May 18, 2010).

Without admitting or denying the findings, Minsky consented to the described sanctions and to the entry of findings that he sold, on an unsolicited basis, unregistered stock that was not exempt from registration on a customer’s behalf. The findings further stated that the sales netted the customer approximately $6million, which he wired to off-shore accounts. Finally, the findings stated that Minsky failed to conduct a reasonable inquiry or due diligence to determine, among other things, if the shares being sold were in fact exempt from registration.

According to Minsky’s FINRA Broker Report (CRD), prior to working as a financial advisor at J.H. Darbie & Co., Inc., Harold Sheldon Minsky was a registered representative with Strasbourger Pearson Tulcin Wolff Incorporated, a FINRA registered broker-dealer based in Culver City, California, Peak Securities Corporation, a FINRA registered broker-dealer based in Largo, Florida, and National Securities Corporation, a FINRA registered broker-dealer based in Santa Monica, California.
