There May Still Be Time to Recover Lexington Capital Funding III Investment Losses

(Last Updated On: July 17, 2015)

Did you suffer losses due to your purchase of the Lexington Capital Funding III Collateralized Debt Obligation (CDO) through Merrill Lynch or another FINRA member brokerage firm? If you did, the attorneys of The White Law Group may be able to help you recover your investment losses through FINRA arbitration.

There is still time to recover these losses under FINRA rules as long as the claim is brought within 6 years of the event or occurrence giving rise to the claim.

The tale of the Lexington Capital Funding III Collateralized Debt Obligation (CDO) investment is a familiar one for people within the securities industry. Underwritten in 2007, by August of 2008, according to Fitch as reported by Reuters, “96.8% of the portfolio [was] rated below investment grade, including 89.2% of the portfolio rated ‘CCC+’ or below.” The Lexington Capital Funding III CDO was just one of many CDO investments that were underwritten in 2007 only to suffer greatly and in some cases deteriorate completely over the next 18 months.

Since the dust began to settle after 2008, there have been numerous cases against financial professionals and brokerage firms to recover losses due to the recommendation and purchase of Collateral Debt Obligation (CDO) investments. In some cases it has been found that the firms and their registered representatives inadequately represented the investments and their associated risks to their clients.

Brokerage firms have a fiduciary duty to its clients to perform due diligence on any investment prior to offering it for sale to ensure that the investment is appropriate for a client in light of the client’s age, investment experience, and investment objectives.
