Recovery of Mariner Access and Mariner 2X Access Investment Losses

The White Law Group is investigating the sale of Mariner Access and Mariner 2X Access hedge funds by Merrill Lynch brokers.  Specifically, the firm is investigating whether Merrill Lynch misrepresented the risks of the Mariner Access and Mariner 2X Access funds.  Based on reports, it appears that investors may not have been made aware of the high degree of risk and speculative nature of these hedge funds.

According to SEC files, the Mariner Access LLC and Mariner 2X Access LCC are both hedge funds offered by Merrill Lynch Alternative Investments from 2005- 2010. These volatile and high-risk hedge funds invested and/or leveraged their assets into various Mariner Funds offered through the Mariner Investment Group.

Alternative investments, like Mariner Access and Mariner 2X Access hedge funds, use an array of investment strategies and involve a high level of volatility. As such, they are intended for experienced and accredited investors who can afford to risk total loss of their investment.

Brokerage firms are required by the Financial Industry Regulator Authority (FINRA) to accurately disclose the risks involved in any investment. In addition, brokerage firms must perform adequate due diligence to determine if an investment is appropriate for each individual investor given the client’s age, risk tolerance, investment objectives, and risk tolerance.

Brokers who misled investors regarding the risks of Marnier Access and Mariner 2X Access, or recommended these investments to clients unsuitably, may be liable for investment losses through FINRA arbitration.
