Investor Alert: Kenneth J. Popek and Calton & Associates, Inc. Investigation

Have you suffered losses investing with Kenneth J. Popek (“Popek”) and Calton & Associates, Inc. According to FINRA Broker Check, Popek was a broker registered with Calton & Associates from June 2008 through January 2015, and operated out of Tampa, Florida.  Before that he was registered with Ameriprise Financial Services.  As of this writing, Popek has at least six customer disputes disclosed on his FINRA BrokerCheck Report with allegations including making unsuitable recommendations, misrepresentation, churning, and breach of fiduciary duty with respect to his sales of options, ETFs, and equities.

According to FINRA Notice to Members 03-49, this puts Popek in the worst .04 percent of all registered persons.  All but one of the customer disputes, which is still pending resolution, against Popek have either settled or resulted in an award/judgment against him.  As a further example of just how egregious the allegations against Popek are, four out of the five cases that have been resolved, have either settled or resulted in an award that is greater than the amount alleged.

The White Law Group is investigating the liability Calton & Associates may have for losses resulting from similarly inappropriate recommendations by Popek to his clients.

Brokerage firms are required to supervise there registered representatives to ensure their recommendations are suitable in light of each particular investor’s age, investment experience, net worth, risk tolerance, investment objectives, and income.  Firms that fail to properly supervise their registered representatives can be held responsible for investment losses in a FINRA arbitration claim.
