Have you suffered losses investing in Accelerated Return Notes issued by Barclays Bank PLC? If so, the securities attorneys of The White Law Group may be able to help you recover your losses in a FINRA arbitration claim against the brokerage firm that recommended the investment.
The Accelerated Return Notes totaling $72.4 million are linked to S & P Oil & Gas Exploration and Production Select Industry Index (SPSIOP Index). According to the prospectus, the notes offer 3 to 1 upside exposure to increases in the index, but only up to a capped return of 24.15%. The notes do not provide any buffer if the index goes down. Investors will lose 1% of their investment for every 1% decreases in the index. Also the notes do not bear any interest payment.
Unfortunately for investors, the index dropped substantially right after issuance in November 2014. Without a liquid secondary market, it’s not easy for the noteholders to exit their investments and mitigate losses before maturity.
Structured products, like Accelerated Return Notes issued by Barclays Bank PLC, are extremely complex and risky. They are only suitable for wealthy, sophisticated retail investors or institutional investors.
Brokerage firms that sell such products are required to perform adequate due diligence on the investments to ensure a reasonable likelihood of success, and to evaluate whether the investments are suitable in light of the client’s age, net worth, investment experience, and investment objectives. Firms that fail to perform adequate due diligence, or that make unsuitable recommendations, can be held responsible for losses in a FINRA arbitration claim.
