Investigation into 3 Former Brokers of Linkbrokers Derivatives Corporation

Former brokers Marek Leszczynski, Benjamin Chouchane, and Henry Condron were charged with securities fraud and conspiracy to commit securities fraud. The Securities and Exchange Commission (SEC) allege that these brokers illegally overcharged clients more than $18 million by misrepresenting the prices of securities they bought and sold on their behalf. They would report a markup price on securities they bought on clients’ behalf, and then markdown the price they told clients when they sold the securities. The firm reaped the difference between the execution prices and the purported prices told to clients. As a result of the illegitimate trading profits the brokers earned the firm, they were rewarded with millions in performance bonuses.

The alleged activity took place between 2005 and 2009 while all three brokers worked for a FINRA registered brokerage firm, Linkbrokers Derivatives Corporation. According to BrokerCheck Report Condron and Chochane both worked for REFCO Securities from 2003-2005 before joining Linkbrokers Derivatives in 2005 where they were joined by Leszcynski until 2010. Condron and Leszczynski worked for Madison Capital Markets from 2011 to 2012. Chouchane worked with Louis Capital Markets from 2011 to 2012.

When brokers, like Leszczynski,  Chouchane, and Henry Condron, engage in illegal trading practices the FINRA registered brokerage firm may be liable for negligent supervision of their employee. If proven, the brokerage firm can be held responsible for investment losses through a FINRA dispute resolution claim. As such, to the extent that these brokers committed securities fraud while registered with a FINRA affiliated firm, the firm may have liability for failing to properly supervise.
